1. Acceptance of Terms

By accessing or using BuildPH ("the Platform"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree, you may not use the Platform.

2. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You must provide accurate, current, and complete information during registration. BuildPH reserves the right to suspend or terminate accounts that violate these terms.

3. Marketplace Rules

• You may only sell original works that you own or have the legal right to distribute.
• Uploading malicious code, plagiarized content, or illegal materials is strictly prohibited.
• BuildPH takes a platform fee on each transaction as described in the pricing page.
• Sellers are responsible for accurately describing their products.

4. Referral Program

Referral commissions are credited to your wallet upon successful payment by the referred member. Fraudulent referrals (e.g., self-referrals or fake accounts) will result in account termination and forfeiture of earned commissions.

5. Payments & Refunds

All payments are made via QR code (GCash, Maya, Metrobank) and verified manually by our team. Digital products are non-refundable once download access has been granted, unless the product is materially different from its description.

6. Intellectual Property

You retain ownership of content you upload. By listing on BuildPH, you grant us a license to display your content on the platform. Buyers receive a non-exclusive, non-transferable license to use purchased products.

7. Limitation of Liability

BuildPH is not liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability shall not exceed the amount you paid to BuildPH in the 12 months preceding the claim.

8. Governing Law

These Terms are governed by the laws of the Republic of the Philippines. Any disputes shall be resolved in the courts of Metro Manila, Philippines.

9. Changes to Terms

We may update these Terms at any time. Continued use of the platform after changes constitutes acceptance of the new terms.

Applicable Laws & Standards

• Philippine Data Privacy Act of 2012 (R.A. 10173) — governs the collection, use, and protection of personal information of Philippine residents.
• General Data Protection Regulation (GDPR) — applies to users in the European Economic Area.
• HIPAA — BuildPH does not collect health information. If any health-related data is incidentally shared, it is treated with the highest level of confidentiality.
• Payment data — BuildPH does not store card numbers. Payments are made via QR code. Payment screenshots are stored securely and deleted after verification.

What Data We Collect

• Account data: name, email address, profile photo, bio, website
• Transaction data: purchase history, payout records, referral commissions
• Usage data: pages visited, features used (for platform improvement)
• Communication data: messages sent to support

How We Use Your Data

• To create and manage your account
• To process payments and payouts
• To calculate and credit referral commissions
• To send transactional emails (purchase confirmations, commission alerts)
• To improve the platform and prevent fraud

Data Sharing

We do not sell your personal data. We share data only with:

• Payment verification — payment proofs (screenshots) are reviewed by our team and not shared with third parties
• Google — if you use Google login (governed by Google's Privacy Policy)
• Legal authorities — only when required by Philippine law or court order

Your Rights

Under R.A. 10173 and GDPR, you have the right to:

• Access — request a copy of your personal data
• Rectification — correct inaccurate data
• Erasure — request deletion of your account and data
• Portability — receive your data in a machine-readable format
• Object — opt out of certain data processing activities
• Withdraw consent — at any time, without affecting prior processing

Data Retention

We retain your data for as long as your account is active or as required by law. Transaction records are kept for 7 years for tax and audit compliance (as required by Philippine law). You may request deletion of non-transactional data at any time.

Data Security

We implement industry-standard security measures including encrypted connections (HTTPS/TLS), hashed passwords (bcrypt), and access controls. Despite these measures, no system is 100% secure — you should protect your account credentials.

Cookies

We use session cookies required for authentication and security. We do not use third-party advertising or tracking cookies.
